The Business Banking Resolution Service admits in Court it was setup to be deliberately unfair, had no duty to complainants, only obligations to the interests and reputations of the banks, and because they paid for it! Contrary to what Treasury Ministers, banks and UK Finance declared when it was setup. For example, John Glen MP, when he was Economic Secretary to the Treasury and the most ardent of campaigners for the BBRS as opposed to Independent Tribunals said: “The Business Banking Resolution Service (BBRS) … offers a free, independent service … The Government has always been clear that the independence of the BBRS is vital to its role.” WHEREAS, Barrister Tom Leary representing the BBRS in a recent Court case said [taken from the transcript]: “The BBRS has fundamentally different obligations vis-à-vis the participating banks … and complainants like Mr Kriwald.” He explained that “the disparity between the obligations is a deliberate feature of how the scheme has been constructed.” He said: “It was the participating banks that set up the scheme … they continue to pay for it. So, it’s their money and their reputation at stake.” He also asserted that complainants “have it gratuitously available to them” and “cannot enforce the scheme rules.” The BBRS literally argued in the Court that the BBRS was not only not independent but that it had been deliberately setup not to be and was setup entirely to protect the interests of the banks who had paid for the scheme. No shit Sherlock! Of course it was. But it wasn't just John Glen MP ho declared it's independence. Here are some other statements asserting that the BBRS would be (or is) independent and/or fair: Andrew Griffith MP (Economic Secretary to the Treasury) (Written PQ answer, 30 Jan 2023): “The BBRS… offers a free, independent service designed to settle unresolved… complaints… Over 99% of UK businesses can access independent dispute resolution either through the FOS or the BBRS. The Government has always been clear that the independence of the BBRS is vital.” UK Finance (trade body speaking for the banks), Stephen Jones (CEO) (press statement on BBRS build-out): “Today marks an important milestone in the creation of a resolution service for businesses that is trusted, transparent and fair… Once fully operational… access to this independent service…” Barclays (corporate site) (Regulatory Information page announcing BBRS): “A new, independent dispute resolution service is being established for eligible small and medium-sized UK businesses…” Lloyds Banking Group — Charlie Nunn (Group CEO) (oral evidence to the Treasury Committee): “I would still see the BBRS as independent, and that is true of all the bodies in the industry… that are funded by the industry. We have independent ways of operating.” Santander UK (Business terms/complaints documents): “You may be able to refer a complaint to the Business Banking Resolution Service (BBRS), an independent organisation set up voluntarily by participating banks to resolve disputes…” HSBC UK (complaints correspondence language reused in council-published PDF): “The BBRS is an independent organisation set up voluntarily by participating banks to resolve disputes. The BBRS is free to use…” Addleshaw Goddard (law firm advising the founding banks) (launch note): “BBRS is a new, independent, dispute resolution service for small and medium-sized businesses in the UK.” Of course Addleshaw Goddard were involved and paid to set this bogus scheme up. And being the lawyers involved will have absolutely known how the scheme was setup to favour the banks and the false representations made to conceal the scam. And will the Treasury, John Glen and Andrew Griffith now demand answers and now give all affected businesses access to a proper scheme to right these wrongs?
