Kar pa zagotovo ne bodo povedali, je naslednje: - Med samim postopkom na VS naj bi prišlo do cele serije sodniških (samo)izločitev. - Na koncu naj bi odločal senat v sestavi vrhovni sodnik Marijan Debelak in vrhovna sodnica Aleksandra Hočevar Vinski. - Oba omenjena sicer karierno prihajata iz Delovnega in socialnega sodišča, bila pa naj bi tudi osebno precej tesno povezana, kar bi lahko bil problem tudi za legitimnost te sodne odločitve.
