Heres a high level of how we got here and the ruling of the ConCourt contextualised. Disclaimer: yet to read the judgment from the ConCourt but summary below will make it easier to follow: What Happened: 29 May 2018: People living on a farm complained to the SA Human Rights Commission (SAHRC). The problem: Farm owner Mr Boshoff cut off their access to borehole water. That was their only water source. SAHRC investigated and said Boshoff + his company Agro Data CC violated the farm dwellers’ right to water and right to dignity. SAHRC order: “Turn the water back on.” Boshoff ignored the order. SAHRC Goes to Court: SAHRC asked the High Court to: 1. Declare that ignoring the SAHRC is illegal. 2. Force Boshoff to restore the water. High Court decision: High court said NO — the SAHRC can’t make orders that must be obeyed like a court. But DID order Boshoff to share water info with the farm dwellers so they could talk about it. Court said: SAHRC is different from the Public Protector. SAHRC should help people by taking cases to court, not act like a court itself. Appeal to the Supreme Court of Appeal (SCA) What the SAHRC argued: “If our orders aren’t binding, they’re useless.” “We don’t have money to go to court for every complaint.” The Constitution says we must ‘take steps to secure redress’ — that means we can issue binding orders. What others said: CALS: International rules say human rights bodies should have strong powers. Gender Commission: High Court was wrong to say some Chapter 9 bodies are more powerful than others. Afriforum: Constitution doesn’t give SAHRC power to make binding orders. Most human rights bodies worldwide are just “watchdogs.” What the SCA Decided: SAHRC cannot issue binding orders like a court can The Constitution says SAHRC must “take steps to secure redress” — that means help people get justice, not give justice itself. Compare to Public Protector: The Constitution specifically says the Public Protector can take “remedial action.” It doesn’t say that for SAHRC. That difference is on purpose: SAHRC’s real job: Investigate, report, educate, and help victims by: - Negotiating/mediating, OR - Taking the case to court for them, OR - Getting them legal/financial help to go to court. Bottom line: SAHRC doesn’t make final rulings. What This Means for Ordinary People: If your rights are violated and SAHRC agrees with you, they’ll help you fight — but they can’t force the other side to obey. Only a court can make a binding order that the police can enforce. Conclusion: ConCourt agreed with the Supreme Court of Appeal
