@Black_Jesus1 @simeonaccount Negligence charges and indeed Justice should not only focus on the outcome of the accident, but also on the sequence of events, the reasonable expectations of drivers on the road, reaction time, visibility, and whether a driver had a realistic opportunity to avoid the collision.

@Black_Jesus1 @simeonaccount Overall, the Polo driver appears to be the main cause of the accident. Negligence charges should serve justice fairly, and if the Cruiser driver reacts to a sudden situation created by the Polo driver, then charging him with negligence may not reflect true cause of the accident.

@simeonaccount @Black_Jesus1 You have a point. Unless my vision is failing me, I also cannot clearly see the Polo indicating before moving to that side. I understand that the Land Cruiser driver could possibly have done better to avoid the collision, but that alone may not necessarily amount to negligence.

Defensive driving matters. Flashing lights doesn’t remove the need to slow down when danger becomes obvious.
Too many accidents happen because people believe having the lane automatically removes responsibility.

The flashing lights were not enough at that point. The Cruiser driver still had time to slow down and reduce the severity of the impact.

@Black_Jesus1 It could be that the driver observed the Polo driver slowing down and reasonably expected the vehicle to come to a complete stop within its lane before turning. We also do not know whether the Cruiser’s speed would have allowed the driver to stop safely under those circumstances.

@Black_Jesus1 It’s concerning that a trained law enforcement officer identifies elements of negligence where none appear to exist. There was an oncoming double-cab bakkie in the opposite lane, which limited the Cruise driver’s ability to maneuver into the other lane to avoid the situation.
