The criminal justice system is grappling with a significant backlog, now exceeding 73,000 cases, prompting the Government to extend the use of Nightingale courts, initially set up during the pandemic. Barristers including Mary Prior KC have expressed concerns over the financial implications of these temporary courts, suggesting that funds could be better allocated to underutilised permanent courtrooms. The backlog has led to severe delays, with some trials not scheduled until 2028, affecting victims and defendants alike. The Criminal Bar Association warns that the situation could erode public trust in the justice system, with vice chair Riel Karmy-Jones KC noting: “The criminal case backlog and the delays to criminal trials aren’t just numbers. They represent tens of thousands of people whose lives are on hold.” The Government recently announced that courts in England and Wales can sit for an extra 2,000 days this financial year, taking the total to 108,500 days. Court officials says the system could cater for 113,000 sitting days if the Government was prepared to pay. Over last few weeks, my firm has been offered a number of cases that are for trial soon at the CC. I’m already double/triple booked so we had to say no because we can’t guarantee we can prep the case&get cover for the trial as chambers are so busy. Never, ever done that before..
