The BJP government’s Transgender Persons Amendment Bill is a brazen attack on the Constitutional rights and identity of transgender people.
This regressive bill:
- strips transgender people of their ability to self identify, violating a Supreme Court judgement
- wipes out the diverse cultural identities of communities across India
- forces trans people to undergo dehumanizing examinations by a medical board
- introduces criminal penalties and surveillance without safeguards
The BJP government hasn’t consulted the trans community and brought a bill which stigmatises rather than protects them.
The Constitution protects every Indian’s right to life, liberty, identity, and dignity. This BJP government is violating our Constitution and destroying India’s rich history of honouring transgender communities in pursuit of its narrow ideas.
The Congress Party unequivocally opposes this Bill.

The Transgender Persons Amendment Act introduced in the Lok Sabha today is absolutely unconstitutional. GoI is excluding from protection persons with self-identified gender and entrenching the authority of "medical experts" in direct violation of NALSA. This Bill must not pass.

The Trans Bill 2026 is fundamentally misguided.
By rejecting the right to self-determination of gender identity, recognised by the SC in NALSA, the bill pushes lakhs of trans Indians out of legal recognition.
It must be referred to a Standing Committee.

The reversal of the NALSA judgement in India is a direct result of American politicians constantly dehumanizing trans identifying individuals. American fascism has a unique quality of seeming into global south and making things worse for the already most marginalized.

The new transgender amendment bill is horrible, it completely obliterates self determination as a principle in the definition of transgender people. I sure hope we have a queer MP who can loudly talk about how legally messed up this is. Surely I wont be disappointed
