Also NON GENTLE REMINDER REGARDING THE SO CALLED "ALLY" OPPOSITION: Marriage is in the concurrent list. State governments can make laws on it. The cent. Govt. In the marriage equality case argued at pains that these CENTRAL acts only cover straight marriage. That that's their sole area of operation. So what's stopping the state governments where the OPPOSITION is in power from making state gay marriage laws if there's no central law Prohibiting it/conflicting with it? Since according to the CG there is a vaccum? Pass a new state act? A State Amendment in SMA ? Let it be challenged in the supreme court? No that won't be done. No politically will. Where's the big speeches now ? So y'all don't get swept by the performative allyship that these people are showing rn. Use them for what they are offering but remember THEY ARE NOT YOUR FRIENDS.

Yeah so the supreme court basically said that the central law can't be interpreted that way because it was never intended to cover the subject, it would be too much of a stretch. So inserting a coverage that was never intended would be invasion in the legislative domain. So an argument can be made that since no central law covers the subject, state law can govern it.

@GrindDead_ isn’t the state law and central law conflicting here? Isn’t that part of the last judgement where supreme court explicitly said that the central law can’t be interpreted to accommodate same sex couples and referred it to the parliament?

@jacobinrot Presidential assent is only required when there is a Conflicting state law. I.e. Two laws on the same subject. My argument here is there would be no need for presidential assent.

@GrindDead_ if they aren’t “friends”, sanghis are our enemies. Btw such a law won’t be challenged in supreme court. There’s no basis for that. The President will simply take the Central government’s side and it will be over. This is what happened with the NEET act in TN.

@PEGmacrogol The "with or without consent" part is like the general rule in contracts, where consent under force isn't treated as true consent. So unless you can show you were forced into the conversion, it would not apply. Specially since the proviso explicitly excludes self perception.

There seems to be a misconception, the bill does not recognise you even though you have undergone Sex Reassignment surgery. It's essentially only for inter sex people.

@PEGmacrogol I believe the " transgender identity" there is in reference to the clause (i) above it where the socio-cultural identities are listed. So it just means the socio cultural identities of kinner, hijra etc. when they are assumed by force.

Good time to remind y'all that no developed country in the world has Anti-defection laws like India. It means that MPs are penalized by law for voting according to their conscience if the party leadership says so. It defeats the point of representative democracy. So unless the Party Whip changes it's stance there's not much that MPs can do.

@adarshwidissues So, on most trains they don't check ID, they just ask name, but this is rajadhani where they do check it, I feel they didn't think it would be checked and used the name they normally use.

@GrindDead_ if they are not educated enough how did they book the ticket on their own? if they booked the tickets through an agent that means it's the agents fault that he booked a ticket with an improper name. if they booked the ticket themselves, it mean they chose to mention wrong name

Trans woman in my train booked her ticket with her chosen name, TTE is not accepting it as the name on her photo ID is different than the name on the ticket. Microchasm of everything going on in this country rn.

@adarshwidissues I know they are technically right, but these people are not educated enough, they have barely received any education, a compassionate approach could have been taken. TTE look the other way all the time could make an exception. Her name is antarika and on the ID its anshika
