With the introduction of the Hate and Extremism Bill 2026, there is a glaring omission: the legislation ignores Indigenous Australians as a group that has experienced-& continues to experience — the most sustained and harmful impacts of racism in Australia. Real legislation requires those who have paid the greatest and longest price for racism in this country to be named, protected, & centred in our laws-not ignored-which simply just magnifies and dismisses the harm. This is not a matter of opinion. It is established in peer-reviewed epidemiological and public health research that racism is a measurable determinant of Aboriginal health and wellbeing (see some peer reviewed articles below). If legislation aimed at confronting hatred in Aust does not explicitly acknowledge & address the documented harms of racism against Indigenous people, then its not evidence-based lawmaking. It argues a hierarchy of harm. And yes, without irony I will be switching off the comments on this post because every time I mention the word Aboriginal on this page the racial vilification and hate is overwhelming …. Just a small sample of what appears on my feed (most from X -I have this page but very rarely post content anymore). When this platform was Twitter, it was easily my favourite platform. You could engage in great intellectual debate and I would post a lot of educational tweets for my followers. When it became X under Musk, it was during the referendum -& I had to get a volunteer to logon three times a day to block and delete -I think most Aboriginal people left X at that stage. All reported. All nothing to see here folks. Australia is currently rushing anti-hate laws in response to the Bondi attacks. But let’s be honest about what’s happening. If this volume and intensity of hate were directed at almost any other protected group, the courts would be flooded and the media cycle relentless. When it’s directed at Aboriginal people, it’s treated as background noise — tolerated, minimised, ignored and treated as if we did something to deserve or provoke it. This isn’t about “offence”. It’s about whose humanity is considered worth protecting. Anti-hate laws in this country have always been selective. Aboriginal people are expected to absorb abuse that would be legally actionable if aimed at anyone else — and to do so with silence. That doesn’t mean antisemitism isn’t real — it absolutely is, and it should be tackled. It does mean that our laws and policies should be driven by solid evidence and applied equally across all forms of hate, not selectively when political pressure demands it. what I see directed at Aboriginal people — openly racist, dehumanising abuse — is rarely taken seriously by law enforcement, media, and the public at large . No group’s suffering should be minimised; no hate normalised. That double standard occurs because it’s impossible, like dysfunctional families, to look at our own backyards-to take responsibility for the racism. And so it continues. Without challenge.
