Finally, "inquests should not feel like legal battlegrounds". This only happens because, again, there is no accountability in the NHS. Everything is seen as a system problem and "no blame" is applied. Sometimes this is true but sometimes it is not. 8/

Our families would firmly oppose any compensation system that uses terms such as “no fault.” Such language is seen as a removal of responsibility, minimises avoidable harm, and undermines trust in healthcare services. It denies accountability and diminishes the lived experiences of those affected by preventable harm. We need a culture that is open and honest, but not entirely devoid of responsibility; the focus should be on fair resolution.

The ruling is not surprising, but it starkly exposes the cruel reality faced by fathers, mothers and partners who suffer avoidable harm and are left with lasting psychological trauma, yet encounter a system that offers neither accountability nor redress. This is precisely why we established our campaign. It is now clearer than ever that meaningful change will only come through legislative reform—reform that recognises, within a maternity setting, a duty of care and a right to recover, correcting outdated legal principles that no longer reflect modern societal expectations. We need a fair system of redress—one that acts swiftly, learns lessons, and sits within a framework that takes responsibility when avoidable harm occurs. Many of the bereaved and harmed families we support believe that transparency, along with earlier resolution and meaningful learning after harm occurs, is vital to improving maternity safety. However, a truly safe system cannot be entirely blameless or devoid of accountability. We firmly believe that accountability is a fundamental component of any safe and effective system. In practice, elements of a “no blame” culture already operate by proxy, and the harm this can cause often compounds families’ trauma and hinders recovery. When early investigations are shaped by a reluctance to be seen as critical of the trust, this can influence subsequent processes, including coronial proceedings, and risks setting in motion a cycle in which families feel compelled to pursue the truth themselves.
