🔴🔥 Stop Arbitrary GST Seizures: High Court Restricts Section 75(12) Recovery! ✅ The Andhra Pradesh High Court ruled that Section 75(12) recovery applies only to admitted, unpaid self-assessed tax liabilities. Authorities cannot bypass the mandatory adjudication process under Sections 73 or 74 for disputes like wrongful ITC utilization. The court emphasized that coercive measures under Section 79 require prior quantification of tax and interest through proper notice and hearing. Consequently, recovery notices for unadjudicated claims were quashed, protecting taxpayers from arbitrary bank account attachments.

@R_N_Vaghani For the 2024-25 financial year, a regular GST-registered taxpayer is required to file Form GSTR-9 if their aggregate annual turnover exceeds ₹2 crore. For those with a turnover up to ₹2 crore, filing GSTR-9 is optional.

🧾 GSTR-9 & GSTR-9C – Complete Annual GST Filing Guide Every GST-registered taxpayer must file their annual return before the due date. Here’s a breakdown of what, when & how 👇 1. What is GSTR-9? : - It’s the Annual Return under GST. 🔹 Consolidates details from GSTR-1 & GSTR-3B 🔹 Includes outward & inward supplies, ITC, tax paid, refund, demands 🔹 Mandatory for all regular taxpayers 2. Who needs to file GSTR-9? : - ✅ All taxpayers registered under GST ❌ Except — ➡️Composition taxpayers (GSTR-9A discontinued) ➡️Casual taxpayers ➡️Input Service Distributors (ISD) ➡️Non-resident taxable persons ➡️TDS/TCS deductors 3. What is GSTR-9C? It’s a Reconciliation Statement between: 📘 Audited financial statements & 📗 GSTR-9 data Required only for taxpayers with aggregate turnover > ₹5 crore during the financial year. 4. Key Change – CA Certification Removed From FY 2020–21 onwards 👇 🔹 GSTR-9C no longer requires CA/CMA certification 🔹 It’s a self-certified form filed by the taxpayer themselves 5. Due Date 🗓️ Both GSTR-9 & 9C are due by 31st December following the end of the financial year. 👉 Example: For FY 2024–25 → Due date is 31st Dec 2025 (unless extended) 6. Common Issues to Check Before Filing 🔹 Match GSTR-3B vs Books vs GSTR-1 🔹 Verify ITC reversals & ineligible ITC 🔹 Check RCM entries & payments 🔹 Report refunds & demands accurately 7. Key Takeaways 💡 ✅ GSTR-9 = Annual summary ✅ GSTR-9C = Reconciliation with books ✅ Both due by 31st Dec ✅ File on time to avoid penalties

For persons with disabilities, buying a vehicle is a necessity, since most public transport in India is not wheelchair accessible. Ending the GST concession scheme for new cars purchased by PWD without adequate public transport is against public policy. Please reduce it 5% GST on cars for persons with disabilities @cbic_india @nsitharaman @narendramodi and continue with the exemption certificate scheme.
