They can be. But just as my case they’re thrown out routinely. The DA would have to prove that you were actually impaired. And there’s this thing called tolerance when it comes to medications. Usually when it does lead to convictions it’s because erratic driving was observed by an officer or an injury accident or something. Not just a prescription being in your system.
