@Barristerblog @Paul_Dargue What I hoped I was saying was (in line with report recommendations): - the way it’s being interpreted, creates to much of an obstacle. - if there’s no other way to interpret it then it needs modification/qualification to prevent the injustice that interpretation causes.

@Paul_Dargue You have a point. @mryderkc was on the radio this morning arguing (like many others) that the "real possibility" test of the CCRC was too high. Well possibly, but how many cases would actually succeed in the Court of Appeal if it wasn't met?

But the main reason I went on was because I think often about my client Alvin Black. If Alvin was still alive he’d have urged me to take the opportunity to say publicly ‘Alvin Black was an innocent man’. So I’m glad I at least got to do that for him today.

I’m grateful I got to talk on @BBCr4today about the need to implement existing Parliamentary Committee recommendations about CCRC reform that can and should already have been implemented. It’d be great to hear shadow Justice Secretary @SteveReedMP commit to doing so.

Even if, on a new appeal, the Court of Appeal decided to maintain his conviction on balance of other evidence, the fact that CCRC wouldn’t even refer it for their consideration in the face of so much new evidence will never sit right with me. There needs to be a change. 3/3

New evidence since conviction included: 1. DNA evidence contradicting Prosn case. 2. Ballistic evidence contradicting Prosn case. 3. Undisclosed convictions of Prosn witness. He asserted his innocence from the moment of his conviction in 1997 until his death in 2019. 2/3

For the rest of my career, I’m never going to forget the case I worked on for years in which the CCRC refused my client a referral to the Court of Appeal several times. He died in prison while serving his sentence. 1/3
