Prohibiting judges from considering immigration consequences at sentencing ignores reality. Rempel Garner’s manufactured outrage could have serious implications for judicial discretion, writes Michael Spratt. hubs.ly/Q04fgvFk0

From me: Courts must consider immigration consequences in sentencing. The CPC's performative outrage has serious implications for judicial discretion & fairness. It is too much to ask politicians for some grown-up honesty when it comes to Justice policy? canadianlawyermag.com/news/opinion/p…

New from me: When Doug Ford refuses to disclose records, loses in court, and then moves to change the law to avoid disclosure, it raises a simple question. What is Ford trying so hard to hide? canadianlawyermag.com/news/opinion/h…

Danielle Smith’s referendum on judges isn’t about democracy. It’s about power. And it’s part of a troubling trend in conservative politics: misrepresenting the facts and undermining public confidence in the justice system. My latest column: canadianlawyermag.com/news/opinion/d…

Why Poilievre’s false claims about my client reveal a much bigger problem with grievance politics. Lying about court decisions to fuel outrage isn’t “holding the system to account.” It’s poisoning it. canadianlawyermag.com/news/opinion/p…

@dytonAD I literally said, “The first example is one I know well because I was there. I represented a man….”

@mspratt Politics has always had its share of “ spin”. I would agree, much like Lawyers who leave out potentially key pieces of information that might have interest to the intended audience. For example, “ I represented a man” ( City of Ottawa lawyer on leave)

@Skydog36764365 @randroid0579094 Time served on remand is notoriously hard time, 3 to a cell, 24 hour lock downs, no programs, no contact visits, all in filthy conditions. It is very very bad.

@mspratt @randroid0579094 Where did he serve his pre-trial jail time? How does that compare with where he would have served after conviction? Honest question.

@Bebejen1313 That is not how things work. He served 150 days in "real jail" part of this was when he was arrested and part was after his plea of guilt (so not awaiting trial). But yes, he didn't get any further time than the real jail he served.

@mspratt @bruce_arthur The article says it was a suspended sentence? Assuming so it’s not really jail for practical purposes and the public eye. I think you might be too far into the work here. PP might be overselling, but I think you’re also underselling here.

@mspratt You are really professional talking about a case you say you over seen as a lawyer. Writing a post on X about it is why you should have your license revoked
