I have a friend whose life changed last June, when a small cottage brick company in Nyeri shut down due to losses and high taxes. That closure didn’t just end a business it left 380 people without jobs. Brian was one of them. He had worked there for two years. Skilled. Disciplined. I first met him when he came to a school I was teaching at to deliver and install cabros you could tell he took pride in his work. But since the closure, life has been unravelling for him. His wife left. He sold his cow goats hens. He no longer has electricity he used to have a small arrangement with his uncle, paying KSh 200 to stay connected. That’s gone now. Today, he passed by my house after a month of not seeing him . I barely recognized him. He looked emaciated… broken. Beaten down by life. And at home, things aren’t any easier his father struggles with bipolar disorder and alcohol. I’m not sharing this for pity. I’m sharing it because behind every closed business is a human story.

The IMF IS NOT ABOVE THE LAW 🛑 In the last hearing on the Odious Debts Petition where IMF pleaded immunity, Okiya Omtatah reminded IMF that immunity does not justify impunity. I have done a small research and I have found that on the 27th of February 2019, Chief Justice John Roberts of the U.S. Supreme Court ruled in Jam v. International Finance Corporation that international organizations do not enjoy absolute immunity from lawsuits. This was a decision that interpreted the International Organizations Immunities Act (IOIA) of 1945. It held that such organizations (like the World Bank Group's IFC) receive the same immunity as foreign governments under the Foreign Sovereign Immunities Act (FSIA). The ruling meant that they can be sued for commercial activities or other FSIA exceptions, rather than having blanket "absolute" protection. The Jam case is the landmark on limiting immunity for similar international financial institutions. Indian fishers and farmers sued the IFC over environmental harm from a coal-fired power plant it financed in Gujarat, India. Lower courts initially dismissed it on absolute immunity grounds and the Indian Supreme Court reversed the ruling, sending it back for further proceedings under FSIA standards. It rejected the prior D.C. Circuit view of "absolute" immunity for international organizations and emphasized accountability for commercial-like actions. Article 2(5) of the CoK 2010: The General rules of international law shall form part of the law of Kenya. Hii kitu ndio sasa imekua tamu. @JoelJirane All lower level facilities are doing excellently lakini apo kwa PGH buratha, people are sharing beds. For a month unakuta mko na 10cc pekee, next ni 5cc pekee. A hospital with around 400 bed capacity has only 6 ICU beds. Nurse to patient ration of 1:11 akwende buana.
