No one is above the law. But nor is the law above reproach - which is why we have law reform. The fad for regarding a mistake as a crime is actually new. Criminality always required intent. It is iniquitous as well as dangerous to criminalise trying to save your life.

Blame is inimical to patient safety just as it is to airline safety. We need candour not defensiveness, learning not criminalisation of mistakes.

Surely we need to prioritise systemic solutions to protect patients in the future rather than castigate people for mistakes in the past.
