Important case law:
🚨🚨‼️SOUTH AFRICA IS IN POSSESSION OF STOLEN PROPERTY!!!
The South African State survives on a single, desperate lie, -- that the land became "theirs" through a legitimate chain of custody.
But, the law of property and the State’s own courts prove otherwise:
In 1847, the British Crown "annexed" First Nation territories. In legal terms, annexation is not a sale, - it is a seizure.
The State’s case in Richtersveld (Constitutional Court : CCT 19/03) was built on the colonial "Doctrine of Discovery", the racist idea that because the Khoi-San were "uncivilized," they had no land rights, and therefore Britain could just take the land and become the owner.
_The Constitutional Court destroyed this_ .
It ruled that Britain’s annexation _did not_ extinguish Indigenous Title.
So, if Britain didn't extinguish the title, they never owned the land.
Therefore, if Britain never owned it, they couldn't legally give it to the Union of SA (1910).
And, if the Union didn't own it, they couldn't give it to the Republic (1961).
And, if the Republic didn't own it, the 1994- Administration inherited a stolen asset.
When this ruling came down in 2003, it sent a shockwave through the Presidency.
Nelson Mandela and Thabo Mbeki had built the "New South Africa" on the 1994- Settlement, which assumed the State was the rightful "custodian" of all land and minerals.
The Richtersveld ruling proved that the 1994- transition was a transfer of stolen property.
It meant that the "Rainbow Nation" was physically built on land that still legally belonged to the First Nation under pre-colonial title.
Mbeki’s administration was terrified because if the Nama had title to the diamonds in Richtersveld, then the Khoi-San have title to the gold, the platinum, and the very soil under Parliament.
It turned the State from a "liberator" into a "successor in theft."
This is where the State’s domestic policy becomes an international war crime:
At the International Court of Justice (the Hague) in Case No. 192 (SA v. Israel), South Africa argued that:
"An occupying power cannot "annex" land and claim ownership.
Resource capture and "stripping indigenous people of their wealth" is a grave breach of law.
_Sovereignty is inalienable and cannot be extinguished by force or administrative decree._
So, everything Pretoria fought for in Palestine, is exactly what they deny the Khoi-San at home.
By their own ICJ- definition, the MPRDA (Mining Act) is an instrument of resource capture, and the TKLA is an administrative decree used to extinguish sovereignty.
You cannot call it "Occupation" in Gaza and "Governance" in South Africa.
