A review application brought years after the underlying events inevitably raises serious delay concerns. Constitutional review mechanisms are not meant to remain indefinitely dormant only to be activated once political pressure intensifies. Courts generally require reviews to be instituted within a reasonable time, particularly where prolonged delay risks undermining institutional certainty and constitutional accountability. That is precisely the constitutional difficulty. The Section 89 panel process was preliminary in nature , it existed only to determine whether sufficient prima facie grounds justified a fuller inquiry. How then does one seek to finally review or neutralise a preliminary accountability mechanism before the broader constitutional process fully unfolds, especially after additional investigative material was later declassified by IPID? At minimum, the emergence of new evidence complicates any claim that the factual and evidentiary landscape remained static or conclusively settled. YOH CYRIL 😭😭🤣🤣🤣

South African academic, anti-apartheid activist and poet - Prof Mazisi Kunene, was born on this day in 1930. Kunene is best known for his translation of the epic Zulu poem Emperor Shaka the Great. While in exile from South Africa's apartheid regime, Kunene was an active supporter and organiser of the anti-apartheid movement in Europe, Africa and America.
