Article 172 is clear: every State Assembly continues for five years from the date of its first sitting, unless dissolved sooner, and on expiry of that period, the Assembly stands constitutionally dissolved. In West Bengal, Mamata Banerjee is going against constitutional convention. There are therefore two kinds of dissolution: one by the Governor’s decision, and the other by operation of the Constitution itself. In the first case, the Governor may request the Chief Minister to continue as caretaker. In the second, by constitutional convention, the Chief Minister submits resignation and is then asked to continue only to avoid an executive vacuum. But convention cannot be one-sided. Once the Assembly is dissolved by constitutional mandate, the Council of Ministers has no House to which it remains collectively responsible under Article 164(2). Its democratic basis ends. The Chief Minister can continue only as caretaker, not as if the mandate still survives. If the Chief Minister refuses to follow constitutional convention, the Governor will withdraw his pleasure; and *withdrawal of his pleasure is tantamount to dismissal of a recalcitrant chief minister* That ensures that constitutional governance, not personal entitlement, prevails.
