By ruling that race cannot be a factor, institutions of higher education are now tasked with finding alternative means to foster diverse student bodies. Chief Justice John Roberts expressed the opinion that universities have erred in prioritizing one's identity based on skin color rather than individual achievements and personal growth. This decision reflects a significant moment in our constitutional history, emphasizing the court's stance on this matter. Justice Clarence Thomas, the second Black justice of the nation, has consistently advocated for an end to affirmative action. In his separate opinion, he characterized universities' admissions policies as lacking direction, relying on race-based preferences to achieve a specific racial composition among their incoming classes. In contrast, Justice Sonia Sotomayor expressed dissent, emphasizing that the decision rolls back decades of precedent and significant progress that has been made in this area.
