Birthright citizenship is a facet of the 14th Amendment (at least as being currently discussed). I find it odd that no one is discussing the actual meaning - the original intent - of the 14th. The 14th Amendment was created to grant citizenship to the then-recently freed black slaves, who, while native born, had no citizenship because the constitutions of the southern states didn't allow blacks to be citizens. (The Union could win the war, but could not change southern constitutional history.) Then, as now, Vattel's "The Law of Nations" was the guiding authority on national matters, including citizenship. It states that a person is either a citizen or an alien. No third option. That made the freed black slaves aliens in the land of their birth. To resolve this situation, the states ratified the 14th Amendment, which granted a form of national citizenship to the freed black slaves. It is a citizenship distinct from de jure state citizenship. In decisions regarding the 14th, SCOTUS ruled that the 14th applied to the freed black slaves, their posterity, and "others similarly situated", meaning people held in some form of bondage, such as the Chinese who built the railroads. The 14th has never applied to anyone other than those stated in the previous sentence. So here we are in 2026, debating the 14th Amendment's birthright citizenship section in relation to people to whom the Amendment is completely inapplicable.
