You guys understand we’re going to lose the birthright citizenship case, right? Before you completely freak out, the traditional understanding of the 14th Amendment, which we are seeking to change, is not an insane reading of it. Nor are our arguments insane like the left has been same. That’s baloney to just shut us up. Neither side is frivolous. It’s a tough call legally and objectively speaking. But when we lose it, and I think we will, don’t freak out that this is some sort of conspiracy. It’s a hard legal decision. Sadly, we have three judges who aren’t even going to try to examine the question and will always vote for what leftists want. But the rest of the court has to make a tough legal call. I think our reading is the correct one. For various reasons, I think they’re going to rule against us. Don’t freak out when they do. It’s not an utterly irrational ruling like so many of the district court opinions we’ve seen.

BIRTHRIGHT CITIZENSHIP AND THE SUPREME COURT Was anyone persuaded by the ACLU attorney? It sounded to me like a lot of distracting arguments and references. The language of the 14th amendment, particularly underscored by the debates and events surrounding it and its very purpose, makes absolutely clear that the 14th amendment had everything to do with freed slaves and their children and nothing to do with immigrants, legal or illegal. The issue of citizenship and immigrants never entered the discussion at the time and probably never even occurred to either Congress or the ratifying states. To be very focused, there is nothing that supports the view that the children of illegal aliens -- illegal by the very fact they are in our country illegally -- are automatic citizens by the fact of their presence in the country. Domicile and allegiance were, in fact, as the Solicitor General argued, the only relevant applications of the word "jurisdiction." If birthright citizenship is upheld then that necessitates the most restrictive immigration and border security policy conceivable.

I think Trump is right about Birthright Citizenship and the 14th Amendment, but even if he loses this case, he broke a massive taboo and set a new standard for future presidents and legislators. Today is a great day for our nation and a historic one, regardless of the outcome.

Worst case scenario: 1. Birthright citizenship ends. 2. Millions of illegal immigrants are born here every year. 3. In 18 years they come of age with no citizenship, no loyalty to the U.S., no assimilation. Many are radical Muslims. Mass deportation has to happen first.
