#RDNH #hancock.com.au #auDRP. The Complainant owns the #HANCOCKPROSPECTING trademark and claims 70 years of common law rights in #HANCOCK. The Respondent acquired the domain as part of an 800-domain portfolio for a premium surname email business, allowing individuals named Hancock to use personalised email addresses, a use recognised as legitimate under established UDRP precedent. The Complainant alleges that the Respondent registered the Domain Name in awareness of the Complainant, with the intention of selling the Domain Name for a sum greater than its out-of-pocket costs.
The three-member Panel found the Respondent had rights or legitimate interests, noting over 13,000 Australians bear the Hancock surname and no website ever targeted the Complainant. Majority panel also found Reverse Domain Name Hijacking (#RDNH), holding that the Complainant was aware of the Respondent's email business use, omitted directly adverse precedent from its Complaint, and filed proceedings only after 12 months of failed purchase negotiations @ wipo.int/amc/en/domains…
