@_JonCorbett @EAGentzler @awkwardlefty_cj At least in my personal experience if no charge in writing is generated, it's because you're being illegally detained. While it didn't do me any good at the time, it was telling. Once they released me, it was also what I was able to use as part of my complaint against the police.

@rollins42 @EAGentzler @awkwardlefty_cj I can tell. :) There are situations where you can be detained and no writing will be generated for you. If you are formally charged with a crime, there will always be a writing available, but your attorney can easily retrieve it from the court.

I'm a law professor. A cop hid a tape recorder in the ER while I was getting stitched up. I was illegally searched as a suspect in a crime that didn't happen (and threatened with jail) on the hood of a cop car. I could go on. Never talk to the police.

@_JonCorbett @EAGentzler @awkwardlefty_cj If they can't/won't put the charge in writing, a good lawyer will be able to argue that you were unlawfully detained or arrested. As someone who is not a lawyer you should always request it in writing so you can tell the lawyer the specific and correct information.

@EAGentzler @awkwardlefty_cj The proper answer is ALWAYS "I'm sorry but I can't answer any questions without my lawyer present. If I am under arrest I request the charge in writing and a call to my lawyer. If I'm not under arrest I request you stop detaining me immediately." Nothing else is required.
