@ryanclinton I sure wish I could convince my clients of this. They always want to define that one thing. Seems quite silly.

Legal writing pro tip: if there is only one of the thing at issue in your document, you don’t have to capitalize the thing as a defined term.

@KatzD Yep. I’ve wondered if the requests for mistrial might slow down.

@ryanclinton I would go one step further. Now that jeopardy has attached, it would be malpractice to seek mandamus for a mistrial because at this point they are playing with house money. The jury quits it’s over, the jury convicts the verdict will be overturned leading to a new trial.

Okay here’s my question. If the judge is baking so much error into this trial that a guilty verdict will not stand on appeal (which he is), exactly whose side is he really helping?
