Legal writing pro tip: if there is only one of the thing at issue in your document, you don’t have to capitalize the thing as a defined term.

@ryanclinton I would go one step further. Now that jeopardy has attached, it would be malpractice to seek mandamus for a mistrial because at this point they are playing with house money. The jury quits it’s over, the jury convicts the verdict will be overturned leading to a new trial.
