I’m getting asked what 1983 lawsuit exists: #KelseyFitzsimmons claimed she pointed the gun at herself, while Noonan testified she aimed at him. Noonan’s shooting would be protected by qualified immunity. But the prosecution was solely based on Noonan’s claim that she aimed at him, which she disputes. She could sue him under 1983 for the prosecution (and for 103 days in jail!)

Regarding a claim of malicious prosecution: she can sue based on her claim that he lied about her pointing the gun at him. Her position would be that had he told the truth (that she never pointed the gun at him) then she never would’ve been charged or jailed (the jailing would be part of her damages stemming from a malicious prosecution - not a standalone cause of action). Her claim would be that he lied about that very important fact which formed the entire basis of the prosecution. Would it survive rule 56? Probably. Would a jury believe her over him based on presidency of the evidence? Who knows? Maybe, maybe not. But it is actionable under 1983. The shooting would not be actionable in my option based on your more detailed comment.

My analysis's would be different although I respect your view. I agree he would be protected by qualified immunity, but more so because police shootings are analyzed under Graham v Connor and Barnes v. Felix (2025). SCOTUS made clear that the standard is objective reasonableness --would another police officer make the same decision not only in a moment of a "rapidly evolving " circumstance involving split second decisions in this case, where a gun suddenly appears. Hindsight is precluded. SCOTUS makes clear an officer could be wrong while the actions are still objectively reasonable. Off. Noonan was cleared by the DA I believe, likely because the of that standard and a court would likely view it this way as well in my view. As to the revocation of bail, that was a sue sponte decision by the previous judge who has absolute immunity and the supreme judicial court upheld the hold. (Totally disagreed with that!) The outrageous order barring contact with the child, I wish could be actionable.

Sgt. Denise Wallet, suspended without pay even though she didn’t violate policy, and it’s all caught on body-cam. I’m usually the one suing the police; here I find myself suing on behalf of the police. Because what I really stand for is the constitution and civil rights.
