If judges insist on a policymaking role instead of just interpreting the law, then their decisions should be as subject to democratic accountability as is any other form of policymaking. And while many will defend overreach with good intention, the risk it carries is that our governments will need use the notwithstanding clause more often (I realize this is common in Quebec). Judicial activism is by no means new, but feels increasingly common in a way that is undermining public trust.
