Yet you make the same category error your fellow "common sense" enthusiasts convey when you focus on observable outcomes while engaging with terms like "proportionality" and "civilian protection." Here's why popular effects-based commentary, like yours, constitutes a widespread category error. As you should be aware, evaluating compliance with #LOAC proportionality rule requires an assessment of whether the EXPECTED incidental loss was excessive in relation to the concrete and direct military advantage ANTCIPATED at the time of EACH INDIVIDUAL ATTACK (pic 1, proportionality excerpt from DoD Law of War Manual). Pointing to a photo of an urban landscape in the aftermath of an armed conflict tells us nothing at all about the expected incidental damage or the military advantage anticipated for each attack you purport to be assessing. What were the conditions of combat at the time? What was understood to be the civilian density at the time? Did this damage occur after targeting activities were complete in order to clear the area of IEDs & tunnels, etc? You have no idea. Nor does anyone else by just looking at the photo you've selected - or any other image stripped of context, for that matter. Regarding civilian protection - we can (and probably should) have an entirely separate discussion regarding whether the current strategic focus on civilian harm mitigation and/or civilian protection is prudent in light of the ongoing pivot to large-scale combat operations. But if we are going to take standards for civilian "protection" seriously, it is helpful to keep in mind guidance from the CHMR-AP that procedures for civilian harm assessments must remain "consistent with mission requirements" (pic 2). In other words, pointing to a photo of the aftermath of an armed conflict while emphasizing "eyesight" & "common sense" is not an appropriate doctrinal engagement with the concept of civilian protection. If you're not considering or accounting for mission requirements at the time the photo was taken, your approach & perspective doesn't align with what militaries such as @IDF are actually doing during armed conflict. Now, if you want to take some isolated social media quote from @Mr_Andrew_Fox from 2 months ago (pic 3) to frame your argument that is certainly a...technique. But you're making the same category error as the rando Andrew was responding to at the time (pic 4): you're drawing broad conclusions about combat activity - including LOAC compliance - based on effects observed in the battlespace. Which, is fine if you're just some rando @X. But that's basically the same flawed methodology @andymilburn8 implemented throughout his recent @WarOnTheRocks article Andrew is commenting on in during your current exchange with him. If the intended audience for WoTR is NGO types @hrw @amnesty @ICRC etc, then your preferred effects-based approach is a perfect fit. But if you want to be taken seriously by actual operators and remain relevant from a doctrinal perspective, you should consider approaching commentary regarding LOAC compliance the same way we do - based on the perspective of personnel responsible for EACH attack AT THE TIME of the attack. Tell ya what. I'll draw up a pitch for a WoTR article this afternoon that takes a more doctrinal approach & send it in NLT COB tomorrow and then we can take it from there. For now, remember this: your "eyesight" tells you very little about terms like "proportionality" and "civilian protection." And effects-based evaluations don't constitute "common sense." That's not how we do it in practice, so don't do it in your public commentary - IF you want to be taken seriously by the operators among your audience.

@Mr_Andrew_Fox @shashj 2 - anonymous interviews with “50” doesn’t move the needle with serious people without some kind of peer review. Can the interviews be redacted and shared? This would increase the author’s and publication’s credibility. Otherwise this piece comes across as a hit job.
