𝐃𝐄𝐑𝐒𝐇𝐎𝐖𝐈𝐓𝐙: “𝐁𝐈𝐑𝐓𝐇𝐑𝐈𝐆𝐇𝐓 𝐂𝐈𝐓𝐈𝐙𝐄𝐍𝐒𝐇𝐈𝐏 𝐌𝐀𝐊𝐄𝐒 𝐍𝐎 𝐒𝐄𝐍𝐒𝐄 𝐀𝐓 𝐀𝐋𝐋” — 𝐀𝐍𝐃 𝐇𝐄 𝐈𝐃𝐄𝐍𝐓𝐈𝐅𝐈𝐄𝐒 𝐓𝐇𝐄 𝐀𝐑𝐆𝐔𝐌𝐄𝐍𝐓 𝐍𝐎𝐁𝐎𝐃𝐘 𝐈𝐒 𝐌𝐀𝐊𝐈𝐍𝐆 Alan Dershowitz just pointed out something that both sides of the birthright citizenship case are deliberately ignoring — and it may be the most important constitutional argument on the table. 𝐀𝐫𝐭𝐢𝐜𝐥𝐞 𝟓 𝐨𝐟 𝐭𝐡𝐞 𝟏𝟒𝐭𝐡 𝐀𝐦𝐞𝐧𝐝𝐦𝐞𝐧𝐭 gives 𝐂𝐨𝐧𝐠𝐫𝐞𝐬𝐬 the power to decide who is “subject to the jurisdiction” of the United States. That’s not the Court’s job. It’s explicitly delegated to the legislature. And nobody is arguing it. Why? Because, as Dershowitz explains, “𝘯𝘦𝘪𝘵𝘩𝘦𝘳 𝘴𝘪𝘥𝘦 𝘸𝘢𝘯𝘵𝘴 𝘵𝘩𝘪𝘴 𝘵𝘰 𝘨𝘰 𝘵𝘰 𝘊𝘰𝘯𝘨𝘳𝘦𝘴𝘴. 𝘛𝘩𝘦 𝘛𝘳𝘶𝘮𝘱 𝘢𝘥𝘮𝘪𝘯𝘪𝘴𝘵𝘳𝘢𝘵𝘪𝘰𝘯 𝘸𝘢𝘯𝘵𝘴 𝘵𝘩𝘦 𝘚𝘶𝘱𝘳𝘦𝘮𝘦 𝘊𝘰𝘶𝘳𝘵 𝘵𝘰 𝘩𝘰𝘭𝘥 𝘵𝘩𝘢𝘵 𝘵𝘩𝘦𝘳𝘦’𝘴 𝘢𝘯 𝘢𝘣𝘴𝘰𝘭𝘶𝘵𝘦 𝘳𝘶𝘭𝘦. 𝘞𝘩𝘢𝘵 𝘮𝘢𝘬𝘦𝘴 𝘴𝘦𝘯𝘴𝘦 𝘪𝘴 𝘢 𝘤𝘰𝘯𝘯𝘦𝘤𝘵𝘪𝘰𝘯 𝘵𝘰 𝘵𝘩𝘦 𝘤𝘰𝘶𝘯𝘵𝘳𝘺, 𝘢𝘯𝘥 𝘊𝘰𝘯𝘨𝘳𝘦𝘴𝘴 𝘤𝘢𝘯 𝘳𝘦𝘲𝘶𝘪𝘳𝘦 𝘵𝘩𝘢𝘵.” On the outcome, Dershowitz was cautious but telling: “𝘛𝘩𝘦 𝘰𝘳𝘢𝘭 𝘢𝘳𝘨𝘶𝘮𝘦𝘯𝘵 𝘪𝘴 𝘵𝘳𝘦𝘯𝘥𝘪𝘯𝘨 𝘢𝘸𝘢𝘺 𝘧𝘳𝘰𝘮 𝘵𝘩𝘦 𝘱𝘳𝘦𝘴𝘪𝘥𝘦𝘯𝘵.” He thinks the most likely result is a 𝐬𝐩𝐥𝐢𝐭 𝐝𝐞𝐜𝐢𝐬𝐢𝐨𝐧 — the Court upholds the broad reading but hints in dicta that Congress has the power to narrow it. Not a clean win, but a roadmap. 𝐓𝐡𝐞 𝐚𝐧𝐬𝐰𝐞𝐫 𝐢𝐬 𝐢𝐧 𝐀𝐫𝐭𝐢𝐜𝐥𝐞 𝟓. 𝐍𝐞𝐢𝐭𝐡𝐞𝐫 𝐬𝐢𝐝𝐞 𝐰𝐚𝐧𝐭𝐬 𝐭𝐨 𝐮𝐬𝐞 𝐢𝐭. 𝐃𝐞𝐫𝐬𝐡𝐨𝐰𝐢𝐭𝐳 𝐣𝐮𝐬𝐭 𝐭𝐨𝐥𝐝 𝐭𝐡𝐞𝐦 𝐛𝐨𝐭𝐡 𝐭𝐡𝐞𝐲’𝐫𝐞 𝐰𝐫𝐨𝐧𝐠.

It was what the CIA whistleblower relied upon in his initial complaint in lDecember of 2019 So those are the facts — So this is basically a situation where the CIA person in the White House who've been left over by Obama writes a a complaint describing alleged violation of the law. This was then picked up in the house, impeached Trump, the Senate of course declined to hear it. But I think what's so interesting here is that this is an organization that's behind it that's funded by USAID that would not exist without USAID in what I think you have to consider to be domestic politics, which is absolutely forbidden. — So this looks like regime change tactics that the CIA and USAID had done abroad being brought back home against Donald Trump”
