Apple Daily founder Jimmy Lai is set to be sentenced over national security charges: Live: hongkongfp.com/2026/02/09/jim… Matthias Kauffman, Deputy Head of the European Union Office to Hong Kong and Macao, arrived with other consulate officials at the courthouse at around 8.40am to witness proceedings. Kauffman said that his office had been observing trials in which activists and advocates had been prosecuted under national security legislation to "signal our interest" in such cases.

《裁判文书已死》 前两天,我想在裁判文书网上检索最新的类案,结果输入关键词,发现2025年的类案少得可怜,检索出来大都是撤诉裁定书,或者是极为简单、几百字的判决书。 曾经被誉为司法阳光工程的平台,如今却像一座空荡的档案馆:门开着,内容却在悄然蒸发。 这不仅仅是我的个人感受,是所有法律人共同的感触。 裁判文书网于2013年上线,文书公开数量逐年增加。 2019年更是公开了近2000万的文书,2020年有1800万,2021年也有1600万。 可是到了2024年和2025年,公开文书的数量仅有750万左右。 我始终感谢裁判文书网的诞生,认为它是中国法治进程的一次跃进性革命。 首先,裁判文书网成为了全民普法的活教材。 它使得冰冷抽象的法条通过一个个鲜活的案例走入寻常百姓家,公众得以窥见司法运作的逻辑。 裁判文书网的公开,为公众提供了权威、完整的事实依据和法律说理。 这种公开本身就是一种最有效的法制教育,能够培养公民的规则意识。 裁判文书网也成为法律职业共同体的智能引擎并统一裁判尺度。 对于法官、检察官、律师和学者而言,裁判文书网是无可替代的工具库。 律师在代理案件时通过检索类案来预判风险; 法官在审理疑难案件时参考在先判决,确保同案同判; 学者能从中发掘司法实践的真实逻辑,推动理论与实务的互动。 可以说,裁判文书网它极大的降低了法律工作的信息成本,提升了专业效率、精准度。 裁判文书网也成为倒逼司法公正的无形监督。 文书上网意味着法官的每一次事实认定、法律适用和逻辑推理都将接受同行与历史的审视。 这种压力迫使法官更加审慎负责的写每一份文书。 这种来自公开的倒逼机制是提升司法公信力不可或缺的一环。 然而,理想丰满,现实骨感。 文书数量的锐减并非简单的开倒车,而是多重复杂矛盾交织下的必然调整。 首先,我们国家海量公开文书和隐私保护之间的艰难平衡。 这个困局非常直观。 打官司对当事人而言,尤其是家事纠纷、商业丑闻或者个人不幸,都不是光彩的事。 尽管采取了匿名化处理,也会在高度互联的信息社会,结合特定的案情、时间等要素对号入座,风险依然存在。 近年来,因裁判文书泄露个人信息引发的歧视、诈骗案件时有发生。 但是,如果为了保护过度而隐去各种信息,又会使文书丧失研究价值,公开意义大打折扣。 所以,如何在保护和公开之前划定合理界限,是亟待解决的技术和伦理难题。 其次,法官不堪重负的现实冲突。 文书上网工作,多数法院最终落在承办人头上。 在案多人少的常态下,法官处理办理日常工作之外,还要承担着额外的文书上网工作的格式调整、敏感信息筛选、去掉隐私等工作。 在结案高峰期,连轴转核心工作都忙活不完,庞大的工作量让其难以兼顾。 司法资源有限,他们只能选择性的公开。 第三,最高法推行培养精品化案例的导向和全面公开文书出现路径分野。 当前,最高法正在大力推行指导案例和人民法院案例库的建设,强调发布这种具有典型性、指导性的精品案例。 这也是标志着司法公开的思路从追求数量转重转而注重质量。 政策导向使得公开文书的数量规模要求降低,裁判文书网的价值也慢慢的打折扣。 第四,目前数据安全、数据孤岛的治理挑战严峻。 裁判文书网蕴含着巨大的数据价值,可用于社会研究、法学研究等,但同时它的安全风险也日益剧增。 如何防止数据被恶意爬取、滥用是在信息时代的一个新的挑战。 最后,谈谈我的观点。 我认为司法公开应该迈向更务实、更精细化的新阶段。 首先,要继续加大裁判文书上网力度。 虽然现在案例库和指导性案例质量很高。 但数量少,而且多是聚焦在重大疑难案件。 而普通百姓关心的物业纠纷、劳动争议、小额借贷等常常被排除在外。 法治的进步不能只靠精品的橱窗,还要需要日常货架的透明。 其次,推行“分层分类”的精细化公开策略。 可依据案件类型、社会影响、法律价值等标准,明确“强制公开”、“依申请公开”和“不公开”的界限。 例如,对涉及公共政策、具有普遍法律指导意义的判决,必须全文公开; 对涉及未成年人、家事隐私等特定类型的案件,则严格限制公开范围。 第三,应该设立专职的司法公开岗,将文书公开工作从法官职责中剥离出来。 同时要推广研发脱敏系统,用技术替代人工进行隐私的修正或者替代。 裁判文书网不该“死去”,而应回归初心:不是摆设,而是阳光。 当一份判决因“怕麻烦”而锁进档案柜,被遮蔽的不只是文字,更是法治的光。 愿我们守护的,不仅是法律条文,更是那份敢于公开、经得起审视的司法勇气。
