Can a legit law enforcement person explain how the restraining order should have been served on Kelsey Fitzsimmons? The obvious is not inviting Justin and his sister over to take the baby. I'm interested in the proper protocol for taking the weapons... The cops asked Kelsey where her guns were, she told them they were in the basement - and for reasons I can't comprehend, they accepted the word of a woman they believed was so unhinged and unstable that she might kill her own child. There is nothing more serious than that, yet there was ZERO effort to locate and secure those guns. WHY? How should it have gone down? What makes sense to me is having two officers wait with Kelsey in the living room (or even taking her outside), while the other went to the basement. Seems like they could have arrested her when they discovered she was lying, no? Why weren't the guns located and secured immediately?

I’m not saying he wore the gloves for a nefarious purpose or that he even purposely lied. But when you cross examine someone, you chip away at their credibility. It’s called impeaching them. And even if innocent, it calls into question wha else they may have “forgot”. Not a conspiracy but an example that it’s possible during said “traumatic” event, it’s possible he overreacted and got trigger happy. That unfortunate decision led to a life threatening and altering injury. That’s a cause of action in a civil suit. So, no, not necessarily a conspiracy, but LIABILITY and possibly a guilty conscience.

The devil is always in the details. I know it doesn’t matter much now as #kelseyfitzsimmons has been acquitted. But if there is a civil case, maybe it does. Officer Noonan testified extensively that he took his black gloves off shortly after entering the house and before he held the baby. That would be downstairs, as we know the baby never went upstairs. Yet look here. That sure looks like his black gloves on the floor right where Kelsey was shot. Again, the details. When you have a simple he said/she said, you look for little lies that otherwise shouldn’t be there. What are your thoughts?

The only acceptable response from N Andover Pd would be to acknowledge they fell short in their response to the emergency RO. They hold no responsibility for the unethical decision the original judge made when she granted such a broad, devastating order without a shred of proof. They are only responsible for their inadequacies and lack of forethought when they ambushed Kelsey with an excessive order, no affidavit, and a poor execution. The “victim” should not have been invited there, or allowed to roam through the house of the alleged offender, in the exact area where they were told the firearms were. They should have considered the well-being of a co-worker who had a recent bout of PPD and was about to be put in an impossible situation. A mental health expert and body cameras should have been available. Although these decisions were reckless and consequences foreseeable, their PR would have been salvageable. Acknowledge the mistakes and promise to do better. I would even be willing to extend some grace if they would either explain their inconsistencies with Noonan’s story, or acknowledge that Noonan saw a weapon, was overcome with fear, and made a split second decision that he now regrets. One of these things is necessary. I would sooner accept that Noonan gave his best years to public service and in a situation where he perceived grave danger, he had the inertia from being manipulated by the Aylaian family, and an ex parte order that emotionally highjacked his decision making. They selected Noonan over a mental health professional. He knows why, so he’s in gestapo mode. And burned into his psyche is the imagine of a mother who had recently took her own life and the life of her baby, and this was experienced with the woman he is now face to face with while she’s holding a gun. I don’t blame Noonan for having PTSD. I don’t blame him for burnout. I’m not even sure I blame him for discharging his fire arm under these circumstances. I blame him for putting his ego and career above his coworker and friend, that not only witnessed the same tragic call he did, but is now faced with a series of accusations that mirror the scenario that cause them both so much trauma.
