As an Australian Jew please do not lump me in with Sall Grover, whose case is heavily backed by Opus Dei linked Catholic and fundamentalist Christian political interest groups seeking to overturn the Sex Discrimination Act to allow increased discrimination for marital status, sexuality, assisted reproduction and abortion. Most people are completing clueless of the Australian political landscape and the real implications of this case.

Sure. She also blamed the apps low uptake on men and accused a group of mostly female IT professionals who tried to make her aware of serious security issues with the app of being transwomen and “a creepy bloke”. While the courts graciously accepted her newfound beliefs to be sincerely held, methinks some scapegoating was potentially convenient.

@themamabun I think i have heard her talk about this and described being woefully uninformed about all of this (including not having basic grasp of the language). But if, in fact, she learned new information and changed her position based on new information, i respect her even more.

So to qualify as a special measure Giggle would have to demonstrate that woman are restricted in obtaining housing and work online due to men, which is demonstrable not true. The Federal Court has deemed substantive equality to be equality in substance. I.e. real and measurable. Not abstract, ideal or imaginary.

Fields where women are over represented as a percentage of graduates are medicine, law (overwhelmingly female at 65%), accounting and most healthcare and education fields. Also, the current senate is majority female. Is everyone really sure we want to allow free rein for single sex only spaces for goods, services and employment?

The Australian Sex Discrimination Act never gave women any kind of 'sex based right', allowing them to arbitrarily discriminate against Men. It is sex neutral and makes it unlawful to discriminate against any sex.

That’s what Sall should have run past a halfway competent lawyer when she set up her company so that she wouldn’t end up in court. But alas, she did not do basic business jurisprudence. And here we are, making her lack of planning everyone’s problem, apparently.

Calm down Canada, we’re in different time zones. There’s a whole section of the act providing exemptions for businesses that due to the inherent nature of the product or service can only reasonably be offered to a specific demographic. That works for eg endometriosis services and mohels, but not social media apps. There’s nothing inherently female about Giggle, despite the profligate and excessive use of pink.

Under the SDA you can’t have a special measure where substantive equality already exists. So if women face no inequality in accessing social media, there’s no grounds for excluding men from it.

@themamabun How thick are you?!? By the same argument, Tickle isn’t disadvantaged by the rare female-only app. He can use social media too! The argument is whether a few FEMALE-ONLY spaces can provide something to women lacking in the general internet. Ie a space away from the pushy men.

@CarlosCMTF And those goods and services are covered in their own section of the act which allows for it. Even Giggle didn’t try to claim that they are a service that by dint of its inherent nature can only be supplied to a specific demographic.

Women can and do have single sex spaces, but you can’t arbitrarily refuse to provide commercial goods or services to people on the basis of sex, gender, sexuality, marital status, pregnancy or breastfeeding unless you qualify as exempt or a special measure. Giggle was a social media app. Not a changing room.
