@tk97813 @AGJamesUthmeier if you are messing around and shoot your gun you might have a point, however with cause HOA can't do anything about it. what do you think they would do take you to court? they would be laughed out of there.

Why do HOAs have so many rules that are not supported by law? I have a pre-mediation invitation from HOA attorneys now bc my lawn has weeds bc lawn is in drought dormancy or died…but state is in Extreme water shortage now…and SWFWMD directed that HOA do not enforce rules that require irrigation. Why did they not pull back their prelawsuit actions..when my lawn look much better that HOAs common areas… …harassment and intimidation… Image attached is their weed lawn…what right do they have to selectively enforce?! But they are blatantly doing it..I reported it…until I see HOA officially pull back the prelawsuit paperwork, I assume, local govt is NOT enforcing Extreme Water Shortage Statewide directives… And not related to firearms…but bylaws and selective enforcement seems to be a common denominator here..

@tk97813 Generally, state law overrides contract provisions when those provisions conflict with the law. The purpose of this HOA rule cannot be read to say that self-defense is not allowed. Show me where an HOA has thrown the rulebook at someone for a self-defense shooting.

@Imgroovin @AGJamesUthmeier It’s about unjust rules that HOAs selectively try to use. Fair enough, not an onion. And if it was an onion, I self-defend myself in that situation also with eyepro when cutting and frying anything..

@tk97813 @AGJamesUthmeier This is the part in the statute regarding discharging a firearm in your home that applies. " Self-Defense: The law does not apply if you are lawfully defending life or property." Comparing firearms and sinkholes is like comparing apples and onions.

@Cangelosifan @MarvSeeker @AGJamesUthmeier No one said that though. But if rules are wishy washy, that opens door to legal problems… I, personally, want my HOA to be ran well…bc any lawsuit against HOA..insurance might not cover and homeowners will be picking up that expense.

No, that’s not how it works. When there are only HOA homes, and rent prices are surging…you have to trust system to work justly.. HOA rules themselves state that laws override bylaws… …but there are just too many inconsistencies, that HOA rules themselves stop being relevant.. Did I mention paperwork toss up here that hides 2 sinkhole reports at the location of our HOA retention pond??? Do you think I am maintaining high maintenance lawn required by HOA when 2 sinkhole reports’ location is ~400’ away from my home.. I got HOAs invitation to participate in prelawsuit mediation while HOA common areas are full of high weeds.. …and SWFWMD issued guidance for HOAs not to enforce rules that would require watering application… …well weed off applications require watering not to burn the soil… Thank you for the platform allowing me to vent!!!

I am not looking for drama. Bylaws have to align with laws! My subdivision specifically had 2 SINKHOLE reports at location which is now a retention pond…prior to construction taking place. HOAs Articles of Incorporation list incorrect permit number from a State Permit Issuing Authority. While the correct permit contains Illegal Dumping into Sinkhile Complaint. But HOA bylaws limit Public Records to only County… …so HOA, Closing Company, Insurance Underwriter did not disclose sinkhole. HOA calls it erosion that we just paid $70Gs to ‘fix’. That’s what I would call drama…

HOA’s will find a way to get around it…like no weeds requirement.. ..what do we do in that situation??? Mulch the whole lawn??? Weeds grow like crazy even in drought here. Please consider this, SWFWMD, when wording your restrictions… Ppl could be pushed to break ordinances and restrictions because your wording is too limited.

Walk a Florida neighborhood after a hurricane and you’ll see the real story. One house loses its roof and becomes a total loss. The house next door survives with minor damage. Same storm. Different resilience. Florida has gotten very good at recovery. But what if we focused more on reducing the damage before the storm hits? Two smart ideas for Special Session: • Eliminate sales tax on standing seam metal roofs • Eliminate sales tax on generators One prevents catastrophic losses. The other keeps families, businesses, and medical devices running when the grid fails. Incentives matter. If we want lower insurance costs and stronger communities, we should reward preparation…not just rebuilding. Florida doesn’t just need faster recovery. It needs less destruction.
