Last night, at the @HWDSB board meeting, my motion requesting a comprehensive food program report from board staff, sponsored by @sabreina_dahab, passed unanimously. This is the first step in bringing back breakfast and food programs for HWDSB since the pandemic.

Hi @OJEN_ROEJ! If the function of the government is to represent the people, then understanding the opinions of the people is crucial. Also, the result of a referendum could potentially deter politicians from abusing S.33 because they would recognize its unpopularity. :)

I partially agree. The ability for the government to override specific judicial decisions is not the danger as this ability is shared in the states. However, it is the abusive use of S.33 from the government that is dangerous. @ProvostLaw #OJENROEJSP23 @OJEN_ROEJ

The referendum would not be the final decision maker about repealing or not repealing S.33. However, it can serve as a check for governments when they use it. If the people do not approve of S.33, then their usage would be under backlash and harm their reputation.

We should also look for ways to increase the bar of using S.33. For example, a test could be laid out by the Supreme Court where the usage of S.33 should be justified. Therefore, politicians would have to justify their use of S.33 and would not abuse their power as easily.

If there is trepidation in repealing S.33, we can use a referendum for the public opinion. The Canadian Government needs to protect and serve its people. Using a referendum to assess the people's voices is necessary on the issue of S.33. #OJENROEJSP23 @OJEN_ROEJ @ProvostLaw

Referendums allow the people to voice their opinions. It keeps the law-makers and provincials in check when using S.33. Using S.33 is an unpopular act from governments, and once a referendum has established its unpopularity, it deters politicians from using this harmful clause.

Therefore, if repealing S.33 is difficult and a long-term goal. Legislators should look for alternative ways to deter the usage of S.33 and mitigate its potential harms. The first step is to recognize that S.33 has been used in a way that it has caused harm to society.

@OJEN_ROEJ @ProvostLaw The process of repealing S.33 is arduous and long. Provinces would not want to repeal the section, because they are the ones who are using this section in the first place. However, the country has saw the exceeding power that S.33 has over our rights.
