This is technically evidence of unethical conduct by a government prosecutor. I’m not exaggerating. This says the ADA really didn’t believe the charges were worth pursuing. He should have dismissed them when this happens. There’s copious scholarship on this very topic.

If they TRULY believed that she had fired at a police officer, do you think they would have been content enough to only ask for time served & maybe probation as a sentence? All week, I've been stuck on the actions (or inactions, really) of the North Andover police in serving an RO on Kelsey Fitzsimmons. They entered her home believing her to be so unhinged that she might actually murder her newborn baby, yet took zero steps to secure the guns they knew were in the house. Now I'm trying to wrap my head around Justin Ayalain's actions (or inactions). Someone help me make sense of these tidbits we learned from the filings and in trial: Justin was so afraid and worried that Kelsey might harm him or their baby that he appeared in front of a judge to get a restraining order and temporary custody. The fear was so bad his hands were shaking and his sister had to help write his statement. YET less than 24 hours earlier, he went to Kelsey's house to get his guns, leaving behind HER GUNS and THEIR BABY. WHY would he do that if he thought she might hurt the baby? And the next morning, Kelsey was begging him to take their son while she went into work for CPR training. WHY didn't he take that opportunity to get his son out of harm's way?

no he lied and and pussied out breaking up with her thru an RO, taking everything from her. Then while she was fighting for her life Bustin Justin and friends broke into her house, and stealing things that didnt belong to him. But from the sounds of it, it sounds like something you might do.

First of all, I know nothing about that. Second, I don’t care about that. We all engage in banter. I like to break @DoctorTurtleboy ‘s balls a lot but I still support him in his case against the McAlberts. But this post was a genuine appreciation of someone that worked very hard to get justice for Kelsey. And even more than that, she was there for her as a true friend. There’s other times/posts that you can engage in the drama, but honest wasn’t it.

When I first moved home from college (Tampa back to NY), I worked for years at my uncle’s law firm. He was a civil rights lawyer and criminal defense for 30+ years. Literally never lost a criminal jury trial. One of the best litigators I’ve ever witnessed - on TV or in person. He was featured on 60 Minutes by Morley Safer and featured many times on the front pages of the New York Times for big cases. One thing he always reminded me of was that a lawyer is a “counselor”. Hence “Counselor at Law”. Working for him he was relentless in not only advocating for his clients but making sure we all were there for them during their difficult times. He always said that a good paralegal was worth their weight in gold. He’d joke that we were the best lawyers he knew. It was his way of showing appreciation. People don’t realize that good paralegals do the bulk of work preparing cases, making sure the attorney is ready for trial and also being there for the client. My point of this long winded post is to give credit to @CourtneyHealy29. I’ve read posts saying Kelsey’s father has credited her for helping get her through these extremely difficult times. I was gonna joke that Courtney was my #kelseyfitzsimmons trial crush (I do that for every trial just to be funny), but I wanted something more serious here. Kudos to Courtney! It’s people like you that are the unsung heroes of these cases and it looks like @BradlLawPC genuinely appreciates you. I’m not sure I’ve seen a paralegal basically sit second chair in a huge trial before. That speaks volumes for how much he respects her. So everyone, please give her the appreciation she deserves.

@SlamminBjB Nine months have passed since the incident, yet Justin remains uncharged with any crime. The allegations of substance abuse against him are still unsubstantiated. The old adage 'possession is 9/10ths of the law' seems to apply here, as Justin continues to have custody of his son.

Why has the North Andover Police Department still failed to charge Justin Aylaian for the many crimes he committed the day he broke into Kelsey’s house? NAPD is apparently sending a message that it’s okay to break into anyone—let alone a North Andover Police Officer’s—home. Their failure to charge Aylaian is corruption.
