Just asking…..
1. NHIF was paying out an average of Ksh 3 Billion per Month. Yet by the time of the cross over there are debts amounting to Ksh 30 Billion after paying Ksh 8 Billion. Another Ksh 12 Billion was unpaid but contested. That means that NHIF had losses of Ksh 40 Billion by the time of the cross-over. How did those losses happen. How do you incur losses equivalent to 13 months of your monthly pay-outs ? Is this the system we are being asked to return to ?
2. In 60 years NHIF covered 9 Million members. In 5 months we have migrated those and added another 11 Million members. In 5 months. Where were those 11 Million members? Is this the system we are being asked to go back to ?
3. In the last 5 months, SHA has paid all undisputed claims up to 31st January 2025. February claims will be paid in the first half of March. This will be the practice going forward despite the contracts providing for payments within 90 days. What is the problem ?
4. There are 4,000 hospitals that were empanelled under NHIF that are yet to make a single claim on SHA. Where are these hospitals ? Are they the ones that were performing 10 hip joint replacements on a single patient ? Are they the ones that were claiming maternity charges on male patients ?

On our way to Olkalou County Headquarters to respond to summons against Hon. Wagichuki Mwangi James, accused of inciting the people of Engineer to reject the President's Jamhuri Day speech, while addressing the residents of Engineer they told us they made the decision to walk out on their own because they are tired of empty promises.
I even tried to read the same speech to them, but for the second time, they refused to listen.

SUPREME COURT JUDGEMENT ON PUBLIC PARTICIPATION IS UNCONSTITUTIONAL
For long, I demurred criticizing the Supreme Court because I hold all its Members in the highest regard. Some were my Professors in Law School. Others have been my friends for decades. Some are my clients. But reading the Judgement on FINANCE ACT has shocked me to the core. Supreme Court has held that PUBLIC PARTICIPATION is a Constitutional Imperative but curiosity erases its value completely by holding:
“ .. National Assembly is under no obligation to provide reasons for accepting or rejecting public views .. “
If National Assembly has no obligation to provide reasons for accepting or rejecting public views, why then undertake public participation? Why then engage in a WILD GOOSE & ILLUSORY process?
Another curious holding was that there is no obligation on Parliament because we have no rules in place! Law is written or established by courts (case law) or law scholarly books & writings or under both local and international customs. We don’t need RULES to give effect to Constitutional Obligations.
Unless the Supreme Court reviews this Judgement only on the extent, remit & principles of PUBLIC PARTICIPATION & make it MANDATORY & NOT DISCRETIONARY on Parliament, this will be the Judgment that destroyed democracy as we know it in Kenya.
This Supreme Court Judgement on PUBLIC PARTICIPATION is REDUCTIO AD ABSURDUM!
