I mean, I'm not arguing that he can claim that defense at all. I am just saying if that's all that happened though and the other guy wasn't continuing to attack him while he was down it might be hard for a jury to buy that. In TN you usually do have to meet the level of force appropriately as well, not just reasonable fear alone. A law group in TN posted "Tennessee law requires that the force used in self-defense be proportionate to the threat." I am not saying he didn't fear for his life, but its really if the jury will believe that or not. Will be interesting to follow the case as it goes to trial.

@petersteele @Breaking911 I mean if he was suckered punch & he reasonably feared for his life, doesn’t matter you dont have a duty to match force. At least in Texas, it’s all about reasonable fear.

Im a little confused here. Typically getting punched, even if a sucker punch, isn't justification to switch over to lethal force. I have a CPL, and a fist fight is not grounds for use of lethal force like this unless you are some small woman or elderly person. Now had the attacker pulled a knife or gun, then yeah, 100% can justify shooting them. This will be interesting to see how it plays out in court.
