Nigerians are demanding immediate intervention by the Nigerian Bar Association (NBA) over the handling of the ADC leadership crisis. Justice Joyce Abdulmalik of the Federal High Court, Abuja, has delivered a fresh ruling in the crisis within the African Democratic Congress (ADC), taking jurisdiction after previously declining it in a related matter. In her latest decision in Suit No. FHC/ABJ/CS/581/2026, filed by Norman Obinna and six others on behalf of elected state chairpersons, the court barred the Independent National Electoral Commission (INEC) from recognising or participating in any state congresses organised by the caretaker National Working Committee led by former Senate President David Mark. The court also restrained the caretaker committee from interfering with the tenure and functions of elected state executives, affirming that their mandates remain valid until May 2026. Justice Abdulmalik held that neither the 1999 Constitution of the Federal Republic of Nigeria nor the ADC Constitution empowers a caretaker committee to override or usurp the powers of duly elected party structures. She further stated that while courts generally refrain from interfering in internal party affairs, they are empowered to intervene where there is a clear breach of constitutional or statutory provisions, and found the claims before her to be meritorious. However, in an earlier suit - FHC/ABJ/CS/1331/2025, filed by former ADC presidential candidate Dumebi Kachikwu and others - the court declined jurisdiction, describing the dispute as an internal party matter. In this latest ruling, the court assumed jurisdiction and proceeded to make orders directly affecting the structure, leadership operations, and congress activities of the party. @NigBarAssoc @afamosigwe
