They hold him until he’s no longer insane or he’s dead, when he’s proven to be mentally sane the court then decides to release or imprison.

A defenders hand being on the line of scrimmage shouldn't be offsides. An offensive linemen twitching his thigh shouldn't be a false start. A player with his toe on the line should be a 3. A baseball being half an inch in foul territory should be fair. See? It's dumb.
