My uncle bought land in early 90s from a single mother who was struggling to pay fees for the children she had. The land was at a prime location near a market my uncle got everything done got the tittle deed and everything. He constructed shops together with rental buildings earlier those years in 2000s. So early this year the kids are all grown have moved to court and are demanding a refund stating that my uncle capitalised on their mother's situation and told the court their mother regrets the decision she ever made. Is their any provision of such? Kama wazazi waliuza shamba unaeza enda kuclaim kupiga refund if it was done ukiwa mdogo.

Sending a Congratulatory message to my friend and former colleague, Hon. Justice Mohamed Warsame for being nominated by JSC to the position of the Judge of the Supreme Court. I followed the interview from outside the country and the Hon. Judge did an excellent job ...and yes your Honour, I would have asked you about emotional intelligence as you mentioned but Hon. Commissioner Nzilani who took over from me handled it very well. From my experience working with the Hon. Judge as JSC Commissioners where we always sat next to each other, I can confirm he has a golden heart as he said. Also very well grounded in Law as he ably demonstrated during the interview. Congratulations once again my friend and 'neighbour'. Very deserving and very proud of you!

I have said many times that the Court of Appeal is the most reputable court in the country and that JurisPESA judges aren't that many in the court. The other TRUISM is that corruption in our courts is primarily fuelled by a clique of senior lawyers. Read this true story that happened this month...please. A very Senior lawyer told his client that he negotiated with three judges of the Court of Appeal who will hear his appeal to rule in his favour for a bribe of Kshs 100 million. The Senior lawyer told his client that the judges want 50 million upfront and 50 million after delivery of the judgment. The lawyer received the Kshs. 50 million deposit for the judges and went straight to buy a prime farm in Kitale. Judgment day came and the court dismissed the appeal with cost. The client was furious and confronted the Senior lawyer for answers. He asked for an immediate refund for the Kshs 50 million. The lawyer swore to high heavens that he delivered the money but that the judges took a bigger bribe from the opposite party. The lawyer then pleaded with the client, that he has a media strategy and had already assembled few bloggers to scandilise the three judges and force them refund the money he bought the farm in Kitale. This strategy faced an immediate challenge when the newspaper dismissed the allegations as defamatory and refused to go along with the lawyer's plan. The bloggers also refused to go along with Wakili's plans. The client has now give counsel a deadline to get him back his Kshs 50 million or he will escalate the matter to @LawSocietyofKe. Things are elephant for the Senior wakili.

A Nairobi woman was robbed of her mobile phone in the CBD after falling victim to a common con trick involving fake cash bundles. The suspect approached her near the NSSF offices (she had just come from applying for her NSSF number), pretending to have picked up money from the ground and suggesting they find a private place (kwa choo za kanjo) to count and share it. To gain her trust, the man first entered the gents’ toilet, then came out claiming the toilets were blocked and smelly. He then insisted that the lady leave her phone with him “to show she could be trusted”. Although hesitant, she was eventually convinced and left her phone with him before heading to check the ladies’ toilet. While inside, she was shocked to discover that the “money” was actually just sliced papers wrapped with a KSh 100 note on top. She rushed out in disbelief, only to find that the man had already vanished with her phone. Ni mbayaa.

Othaya Girls, are in the news. And Kenyans are sharply divided over the matter. The school welcomed back students ready for the new term. However, they were very strict on holiday assignments. The teachers checked on who complied with the instructions issued when they were breaking for holidays. So today, all students who had not completed their homework were sent home. To finish the work and comeback on Monday next week with all assignments perfectly done. Now social media hasn't stopped talking. Some are against the action taken by the school. They don't believe having incomplete assignments warrants sending a student back home. They are saying holidays are for resting and if the school thinks of punishing the learners then it should be done within the school. Others are of the contrary opinion. They say this is the highest form of indiscipline by the learners. No excuse is enough bearing in mind they were at home for close to a month. If they were to do well, discipline comes first. And no better place to instill this than at home in the hands of their parents. Was it a good idea by the school?
