In fact, there was no power to make the transfer to the 2 sons under the power of attorney, and the wife’s transfer was in breach of fiduciary duty, which gave rise to a constructive trust over the property (@yingks - may be of interest)…

An interesting new decision involving constructive trusts, indefeasibility, knowing receipt and equitable compensation: Turner v O’Bryan-Turner [2022] NSWCA 23 jade.io/article/906422 (thanks @MelbConstrucLaw for tipping me off about it).
