Unfair Child Support Law Often husbands/fathers ask me this question: "She took the child away from me, does not let me even meet the child. She is asking for half of my income as maintenance for herself and the child. If she says she does not have enough money to provide for the child, why does she not hand over the child to me? I am more than happy to take care of all the needs of the child, and I will not even ask her for money." My response to them always is this: Your logic is sound. But the courts say that the mother should have custody, and the father should pay for maintenance. If he wants to see the child, he should file his separate applications under various provisions of law. The excuse given often is that the mother who takes care of the child will not have enough time to make a living. Even if the mother is earning through job/business, the Courts say that the father cannot shy away from his "duty". Some may say this is a sound argument. But now lets reverse the situation. I have consulted hundreds of husbands who still have custody of the child. Either they were precise with legal strategy, or they were lucky, or the mother wilfully abandoned the child. In this situation, we have contemplated seeking maintenance for the child, from the mother. But when I tell the client I have seen few occasions when the husband tried this, and every time the Judge threatened to hand over custody to the mother, the client immediately abandons the idea.
