This article is complete garbage. It claims that the symbol is not protected by the First Amendment because it is incitement, but neither mentions the relevant legal test nor presents any argument or evidence necessary to satisfy the test. The test is whether it's objectively likely to cause imminent violence. (See Brandenburg v. Ohio.) The supposed evidence/argument (cleaned up): 1) "Hamas has used it countless times in videos that they've published of attacks against Israeli soldiers[.]" How does that show that the way SJP is using it will cause imminent violence? It absolutely does not. 2) "This is a symbol of a foreign terrorist organization that's been designated by the United States." Again, that does not mean it's likely to cause imminent violence when SJP uses it. 3) "The presence of the symbol on Berkeley's website may be viewed by some as promoting hate. This red triangle symbol is very deliberate. SJP knows what they're doing." Again, does not in any way even suggest that SJP's use of the symbol is objectively likely to cause imminent violence. 4) "It is a symbol used by Hamas to designate targets to attack ... the inverted triangle [is] a terrorism symbol used to communicate a message of threat, intimidation, and violence." Again, even if that's true, how does that even suggest that SJP's use of the symbol is objectively likely to cause imminent violence? It really looks like this article is deliberately designed to make people dumber about what the First Amendment protects and clumsily equate the very strict US incitement standard with European-style hate speech restrictions.
