Una too funny for this country. There is a principle in tort law called the Bane and Antidote. The principle is that, if you are going to allege that a statement is defamatory, you cannot just pull one line out of thin air and run to court with it. You have to read the entire publication. If, when read as a whole, the context neutralises the damage, the sting is gone. The claim dies there. Knowing that principle, I couldn't help but laugh at this. That is exactly what happened here. Read that thread from the beginning. This man supported, publicly, a position that championed "all men are rapist / men are guilty of rape until proven otherwise". Someone quoted his own tweet and said by your logic, here is what you are, "a rapist". Now he wants to sue for defamation. The quoter did not call him a rapist. The quoter held up a mirror. He took his own argument, followed it to its logical conclusion, and showed him what it looked like. That is not a defamatory statement. That is a syllogism. That is rhetoric. That is what happens when you make extreme claims in public discourse. Defamation law was never designed to protect you from something like this. No reasonable person reading that thread "in full context" would come away genuinely believing this man was being identified as an actual rapist. The context neutralises it completely. The bane and the antidote exist in the same publication. There is no sting. And without a sting, there is no defamation. All in all, lawyers will cash out. That's a good one.

King Mitchy is trending because a lady is claiming the charity-influencer charged her ₦1 million + flight + hotel booking, to crowdfund to raise ₦45M for her husband with kidney failure. While BBNaija Diva Tacha, collected ₦5M and Maryann ₦750k. Yet they only made ₦100k from Mitchy’s post, after she posted once and refused to post again as agreed, demanding more money. And then the middleman/manager said Mitchy pulled out because she’s not happy that the money being raised is not going directly to her account. Because normally, she uses her account to raise funds and then splits whatever is raised with the sick persons family. — according to the lady in the video. [the video was sped up for quicker viewing] Mitchy initially demanded 1m for post, total booking, return ticket for herself and crew total of ₦2.5M. Meanwhile the family only had ₦8M, from which they paid ₦6M for PR. Tragically the husband later died. According to the lady, they only benefited from Maryann who posted daily for seven days that got people in diaspora supporting. However, she was engaging with two middlemen, one in Nigeria the other in Canada. Nigerians are shocked to learn that a charity influencer like Mitchy and Tacha would charge a dying person for crowdfunding. The story and video was publicized by gossip blogger, Vampz. If the prosecutors felt that Winifred was a compellable witness, why didn't they issue a subpoena in her respect??

As the solicitor to the family of the late Ochanya, I have been hesitant and very cautious about making public statements regarding this tragic case. However, people have been tagging and reaching out to me for clarifications. @Winifunds has very serious questions to answer regarding what she knows about the circumstances of the death of Miss Ochanya. I have attached certified excerpts from the judgement of the Federal High Court sitting in Makurdi, delivered on 28th April, 2022 in the charge filed by NAPTIP against Mrs. Felicia Ogbuja (Winifred’s mother). Mrs Felicia was convicted and sentenced to five months imprisonment for failing to protect the late Ochanya who was under her care. If you read page 14 of the judgement, you will see that Winifred’s name came up in the course of the proceedings. A witness testified under oath that Winifred caught her brother (Victor Ogbuja), who is still on the run, and reported to their father, Mr. Andrew Ogbuja. Based on what I know, Winifred refused or failed to cooperate with the investigators. She failed to make a statement regarding her role in the case. Efforts by investigators to get to her proved abortive. If she had cooperated, it would have likely had a profound impact on the quest for justice for Ochanya. That is all that I can say at this time.

@Nueldigitals @InibeheEffiong I don't understand. Are you the gatekeeper of Twitter? The law doesn't work on emotions. Some witnesses are competent but not compellable. Some of you should know a thing or two about how the law works. It's tiring.

For the first time in 2 years, our compound gate man travelled. Just two days. And everywhere has scattered. Normally the man does everything. Open gate. Pump water. Fuel the generator. Wash cars. We didn’t even realize how much work he was doing until he left. Yesterday morning, water finished from the tank. Everybody came outside looking confused. Nobody even knew where the water switch is. Later we contributed money to buy fuel for the generator. Then someone asked, “Who will go and buy the fuel?” Silence. Nobody moved. Last night I came back home without my key. I knocked and banged the gate for almost 45 minutes. Nobody opened. This morning I even had to wash my own car. First time in years. Then the waste disposal people came. Nobody attended to them. They just dropped the waste and left. Omo… Only two days without our gate man and this compound has completely lost direction. It’s going to be a very long week for all of us.
