@byelin I agree. Challenging the intellectual capabilities of a SCOTUS justice always seemed a bit absurd to me. Call them ideological, activist, etc., but it’s just disingenuous to attack their intelligence.

I welcome the hate for this, but the whole "Ketanji Brown Jackson is stupid" discourse is itself stupid and also racist. There's literally no evidence from her opinions or questions that she's stupid. It's just people who themselves are ignorant about the law. Being in a one person dissent happens sometimes (see Alito in the WBC case). Or if you want some famous heroic examples, Justice Harlan in Plessy.
Same was true for Thomas, who has faced this "DEI hire" stuff for 35 year. He has a judicial philsophy that I deeply disagree with, but he's brilliantly smart.

In my humble opinion, Roberts, Kagan, Gorsuch, Kavanaugh, and Barrett are solid, pragmatic, apolitical justices. In recent years, Breyer, Souter, and Stevens would also be in that camp.
Thomas, Alito, Sotomayor, and Jackson, on the other hand, always seem to have an agenda.

I fucking hate the “minimum wage is for high schoolers” talking point.
A. No it isn’t, that’s historically inaccurate.
B. Telling a kid to work hard and earn money the “right” way, then turning around and saying he deserves less just because of his age is bullshit.
Pay should be based on performance. Nothing else.
If you’re against raising the minimum wage, that’s fine. Make a better argument that isn’t belittling kids trying to work hard and earn something for themselves.

This is very well said, although I disagree with Justice Kagan being lumped in with Justices Sotomayor and Jackson. Kagan is more of a pragmatist; the other two have agendas.

You guys understand we’re going to lose the birthright citizenship case, right? Before you completely freak out, the traditional understanding of the 14th Amendment, which we are seeking to change, is not an insane reading of it. Nor are our arguments insane like the left has been same. That’s baloney to just shut us up. Neither side is frivolous. It’s a tough call legally and objectively speaking. But when we lose it, and I think we will, don’t freak out that this is some sort of conspiracy. It’s a hard legal decision. Sadly, we have three judges who aren’t even going to try to examine the question and will always vote for what leftists want. But the rest of the court has to make a tough legal call. I think our reading is the correct one. For various reasons, I think they’re going to rule against us. Don’t freak out when they do. It’s not an utterly irrational ruling like so many of the district court opinions we’ve seen.
