Senior lawyers must answer for their own mistakes; junior lawyers should not be made to shoulder the blame for the failings of their superiors. In Badat v BP Australia Pty Ltd [2026] WASC 48, the Supreme Court of Western Australia rejected attempts to attribute a failure to comply with court orders to a junior solicitor who had apologised to the court. The court emphasised that responsibility for procedural failures cannot be shifted to junior practitioners. Justice Howard made it clear that supervising lawyers remain accountable for the conduct of litigation and cannot transfer responsibility for non-compliance to more junior members of the legal team. In addressing the issue, the judge stated that any idea that it is appropriate for a more junior practitioner to be taking responsibility on oath for the failings of a more senior practitioner is to be rejected outright. Justice Howard further emphasised that responsibility is not to be moved downwards. The decision underscores an important professional principle: senior lawyers must answer for their own mistakes and must ensure proper supervision of junior practitioners involved in legal proceedings. Just read a judgment about a woman who was admitted to Lehurutshe Hospital in the North West and delivered a stillborn baby. She was discharged without being shown the baby's body. The deceased infant's remains were collected from the hospital mortuary by a funeral undertaker, accompanied by family members, and buried that same day.
