The biggest difference between a U.S. federal judge (or any other judge serving on an independent court anywhere in the civilized world) and the employees of regulatory agencies is that no one can tell a judge to fabricate a "competition concern".

A couple of ABK-related documents have become available (thanks @PostUp_SOG). Nothing new or surprising there, but briefly: 1. CAT order: catribunal.org.uk/sites/cat/file… This is consistent with what was ruled orally at the end of the case management conference on Monday. Thus no definitive but merely a conditional stay. I discussed the Monday CMC in a long Twitter thread followed by a recorded Twitter Space. Next step: actual stay (provided that the evidence to be submitted primarily by the CMA will be deemed sufficient). Should be a non-issue and will result in another order. 2. European Commission published Advisory Committee position on its draft decision: ec.europa.eu/competition/me… The Advisory Committee gave DG COMP backing for the decision, on some items mostly and on others absolutely unanimously. Good: no console theory of harm, no console game theory of harm, and streaming remedies approved. Wrong in my opinion but inconsequential as remedies were approved: foreclosure and conglomerate theories relating to cloud gaming and also with a view to Microsoft's PC operating system strength. I view that as political stuff and I disagree. I'm totally convinced that those theories of harm would not have survived an EU General Court review, but if the EC had blocked the deal, the merger might be dead by now, and the remedies are good for gamers, so the glass is far more than half-full though the theories of harm are not based in fact or law. Next step: publication of actual Commission decision in redacted form.

@JesterAronn @tomwarren I’d say if either side walks it will be MS. After their stock rose 4% in one DAY yesterday on the back of their new AI product, they might be thinking “wtf are we doing spending $70bn on gaming just to maybe, one day catch up to Sony”. If I were ABK, I’d be extended ASAP.

Microsoft’s proposed Activision Blizzard deal has missed the original deal deadline and ticked over into July 19th. Now we wait to see if there’s an announcement of a deal extension or just an understanding neither side will walk away from this transaction

@kingdavidotw Market cap people. Far different then net income… no. They didn’t “make” 140 billion in cash. What happened is a future valuation of this office thingy which is far overvalued ..

@SSing320239 @NikoMueller MS is paying cash for ABK. Even after the deal closes they will have over $100B cash in the bank. There is no debt

@Samsam143435923 @NikoMueller And what I see. MSFT has 30 B cash left after acquisition. Correct me if I’m wrong. Maybe they held separate or isn’t counted as they are holding massive treasuries. 2022 they had about 104 B in cash

@geis_shane People always complain about the price of something. But then spend all day on their video games. Fapping. Vaping. Junk food. Yet going to work is somehow a foreign concept to them and don’t realize the treasure goblin isn’t dropping real life loot

I don’t want to hear any more acquisitions talk from any Xbox guys that cry about things going up a few dollars or services changing…..you CANT have it both ways

@Samsam143435923 @NikoMueller He said they earned. They didn’t earn that in cash. Yes I know how much cash they have. Yea I know no debt from ATVI, I said that as in they can pull loans if need be or wanted. Apple does this often and to large amounts ( 75 B last I checked )

@Nick_Marseil I basically play on cod campaign. So I buy when on sale and play the difficulties. Much easier for me then forgetting I subscribed. Either way gamepass is nil. Don’t buy two Starbucks ( or insert your junk food ). Many ways to save $15..

People who only play CoD, which is the vast majority of that community, would actually save money by getting it for $70 rather than $180 for the year of Game Pass they would need before the new one comes out. They don't care about the rest of the catalog.

@FOSSpatents Foss I love you. I disagree -cma could reject bringing back to CAT at oct. ? Then back to cma -renegotiate contract for 1 1/2 months is too short. Then what file another -much is dependent on break fees. Possible share increase. As to how long they extend

If there was going to be an extension, I can't imagine it would reach by more than a few days beyond August 29, given that the new CMA decision will be done by then at the latest (they strive to do it faster).

@FOSSpatents And yes as MSFT tries to save face for cma they just brought in a big no no. Allowing no cloud which opens the door later to divest any “potential harm” for any company forward Remember a leopard never changes it’s spots.. we would have seen them allow closing if so

@FOSSpatents I will place my money though this is the arguments. How long to extend and what should or shouldn’t come with that. Then MSFT weighing to just close or extend given they “pay” either way. I standby waiting to be wrong as none of us are MSFT lawyers.
