@Hattusilis_III Good point. However, not sure an ASX listed company has ever used clawback. All the malus cases I know of have cut unvested equity with the exception of Alan Joyce who lost vested equity. That could have been a tricky legal position for the QAN rem committee but Joyce didn't sue.
Interesting article, but the CEO-pay debate is built on a trick: inflate the potential package so high that any clawback looks like punishment. If a CEO can earn $30m but ends up with $12m, the headline focuses on the $18m they “lost”. But the starting point was ridiculous to begin with. The remaining $12m is still miles beyond any real labour-market logic. We keep talking about the haircut and ignoring the inflated baseline that makes the haircut look impressive. That is how the system protects itself.
