@Z1netsu_0 @MizusPuddle Mentioning they have backups does not create a warranty the "backup" plan will protect, nor ensure it would be released to you. Also, suing a failed small business won't get you made whole. Get in line with the other creditors for $0, even if you won the case.

A ton of riggers now and talking about how they have a million backups and "dead man switches" to protect your cmo3 file now that casual vtubers are informed about how important and nessecary they are. I just gotta come out and say it, I think they're lying to you. It's a very easy and unfalsifiable way to claim they've fixed the problem without you being able to see any sort of protections. It also still doesn't fix the issue cause you're still required to come back to them for more work until they kick the bucket. Riggers, just give your clients their files. Please, just stop digging.

This trend of going after artists and riggers is just wild to me. Don’t blame or put weird expectations on a whole group of people because a couple of them are assholes. They literally are the backbone of Vtubing.

The thing that becomes an issue is that you can take a blade that was made by a bladesmith to somebody else to have it repaired if it is repairable. You can take it to somebody else to style it and sharpen it. I don't think the file would be considered a tool. I think the program used to make it would be considered a tool.

@MizusPuddle @Z1netsu_0 Okay so Riggers in question do have the opportunity as in the sense more of a bladesmith who has to make his own tools. So it would determine is the court file it as a tool or as a recipe both are legally protected but tools are much more socially defined concept

Communication solves a lot of issues, as long as the agreement is upheld. But that's not going to work all the time. Talking it out beforehand doesn't prevent one side from not upholding their end of the deal. If somebody gets commissioned and either the commissioner or the person commissioned ghost the other, do they get the similar treatment? When somebody is getting commissioned, do the person placing the commission and the person being commissioned each have similar standing for negotiation?

@Z1netsu_0 I said a couple times now that the responsibility should be on both parties to communicate their needs and come to an agreement before money changes hands or anyone commits to the project. I truly believe communication can solve this issue.

Probably. The big factor of it would probably be about restoring the rig if it gets damaged somehow. Upgrading/updating the rig. And whether or not the rigger gets to force near exclusivity. If you buy a painting and it gets damaged then you can go to a professional restorer. You aren't forced to go back to the original artist. But I'm not sure how much weight that would have behind it.

@Z1netsu_0 The problem is the lack of real contract is gonna make this more of a fight over what a reasonable person would think based on their communication and the web of other copyright, which a lot of artists forget they don't suddenly own everything cause they did one part of the brand

Like, if rigging was as easy as some are suggesting. Everyone would do it, right? There is plenty of free tutorials, steps by steps and tips share. In my own case I didn't wanted to pay, so I learned it myself. And is never get any easier to do, let me tell you that much lol
