The unproven shove, uncooperative attitude in the hallway, and “aggressive” questioning remained as speculation, lacking concrete evidence of any crimes.
The police enforced the property owner’s request and did not make any arrests for assault or obstruction.
Security customs, “VIP protocols,” or the notion that “you shouldn’t talk back” are not legally binding.
We are governed by statutes and the Constitution... including speech protections and the high bar for criminal charges.
Treating disputed allegations or officer commands as automatic violations is a common thing but rather ignorant. Obstruction is a physical act, not a verbal one.

Valentina's brother was stopped and questioned by law enforcement as part of an investigation regarding a complaint of an assault against one of Congressman Carter's security detail. The video her brother shared with the officer did show that he impeded Mr. Carter's path to allow Valentina to hit him with a barrage of questions. He was asked to step back but refused. Witnesses were questioned separately and all stated the same thing - - Valentina's brother was the aggressor after being directed to stay back.
It is generally not legal for a citizen to physically block the path of a congressman—or any person—to ask questions.
Constituents have a right to confront officials with questions, but this should be done in a manner that does not violate the personal safety or freedom of movement of the official... You can ask questions, hold up signs, and speak loudly, but you cannot physically stop a congressman from moving or force them to answer your questions by blocking their path.
A congressman's security detail—whether they are United States Capitol Police (USCP) officers, personal security personnel, or local law enforcement—can push back, restrain, or remove an aggressive person who is impeding the path of a member of Congress.
Security personnel are trained to maintain a secure perimeter around the protected individual, and their actions are guided by protocols designed to prevent threats and ensure the safety of the lawmaker. According to the video, it appears that Valentina's brother breached the secure perimeter around Congressman Carter.
Last, a police officer can in fact tell a person being investigated to be quiet or stop talking over them to maintain control of an interview or investigation. While citizens have the right to remain silent, they do not have a constitutional right to talk over or interrupt an officer during questioning, and such behavior can be viewed as obstruction.

Valentina Gomez, who ran in TX CD31 primary and lost badly appears to now be anti-law enforcement because things aren't going her way. Without any proof, she stated in an X post that the Round Rock PD likes to release false police reports and that the officers are bad. In the body cam footage, police officers are investigating a complaint made against her brother who allegedly assaulted a member of Congressman Carter's security detail after being told to stay back. While being questioned, Valentina continually tries to talk over the police officer, and her brother accuses the officer to his face of being on a power trip. He refused to show the officer an ID. He lied and said that he didn't have it on him, but it turned out that he did.

They really have to fix the algo here. You share or view one meme about Black Snape (because hilarious) and the entire algo is 24/7 Black Snape for two days straight. The algo thinks because someone interacts with one thing they want infinite of that thing. It’s wrong. It forces people into bubbles they don’t want to be in. Sometimes people want to share a meme, and then go back to normal. Or sometimes they are sent a meme, open it up, and now the feed thinks they want more of that content. No, they were just sent a link and clicked it. It really ruins the experience. Not every detour needs to become the main path. It’s a flawed system. It’s hypersensitive and doesn’t realize just because (I.e. you saw a car wreck on the feed and were shocked) that you want infinite more car wrecks. No. Obviously your eyes are going to linger on the shocking thing, but that doesn’t mean you want to seek it out. X doesn’t discern that.
Needs to be fixed. Ruins the experience. And there’s no way to reset the feed back to normal. You just have to try to interact your way back into normal somehow.

While I strongly disapprove of Valentina Gomez’s candidacy and believe she should never hold elected office, I believe her brother was in the right during this incident.
First, there is no public evidence that he shoved or assaulted anyone. The bodycam footage does not show any physical contact initiated by him, no one was injured, and ...most importantly ...he was never charged with assault.
The allegation remains an unproven he-said/she-said claim from the event hosts.
Second, Texas law does not criminalize suddenly approaching a public official to ask questions or filming that official at close range. Citizens have a First Amendment right to record and question elected officials on matters of public interest.
There is no statute prohibiting “aggressive close-quarters filming” or questioning a congressman at a private event.
Third, during the police interaction, the officer had no legal authority to command the brother (or Gomez) to “be quiet” or stop speaking.
Under Texas Penal Code §38.15(d), mere speech ... even persistent interruptions or talking over the officer ... does not constitute interference with a public servant’s duties.
We are governed by law, not by an officer’s subjective desire for control or feelings of annoyance.
I have no objection to the trespass warning itself. The resort, as private property, had every right to ask them to leave and have police enforce it.
However, the lack of any charges for assault or interference shows that the brother did not violate any criminal statute.
He was simply exercising his rights to record and speak, and the officer overstepped by attempting to silence protected speech.
In short, private property rules allowed the removal, but the law does not support treating the brother as the wrongdoer here.
