@AILawyerAfrica I agree with robust business continuity - the risk comes if the SaaS vendor or company administrator does not cooperate post bankruptcy/trigger event. Here is a classic case of SaaS vendor not cooperating post trigger including an IP dispute to boot. bit.ly/3lzw66I

@jen_bonnett Software escrow is definitely still a thing. But the concept has shifted from traditional deposits of source code to more complex continuity solutions for SaaS hosted applications in AWS/Azure. Check out escrowlondon.com to learn more. UK HQ with an office in Atlanta.
Does anyone know if software escrow is still a thing? It used to be when a big company did business with a startup, they’d set up a software escrow arrangement such that the Big Co could get the source code if the startup went under. Still happen? If so, who are top vendors?
@rchase Yes. As an operator, it is one of my big concerns.
There are two things you could do:
1) Have insurance coverage that will refund the software subscription and will pay out the many migration cost.
2) You can consider using a SaaS software escrow service.
@buildscientist That these days most software on its own is useless. The 'software' element of a microservices-based SaaS platform is a fraction of what you'd need to get it all up and running.
Thought: companies offering services (as APIs) in the cloud should have Solution-Will-Be-Open-Sources-When-Company-Bankrupts clause in their terms of service.
